Help with sound recordings and copyright issues for Duke Nukem level
Archive: 18 posts
Hey there i am creating a 2d duke nukem level and i want to use actually sounds from the duke nukem games. I have already recorded a few voice overs of him saying things like "Come get some" and things like that but i am not sure if this will be usable due to copyright. Does anyone know if recorded sounds from a game are usable or not in LBP? Also what are the best methods for recording voice in the game i am using the PS eye and the mid from the PX5 headset. The eye has best quality but very low volume and the headset is slightly louder but more crackly. I am recording straight through the computer speakers into the headset and eye and its not too bad but i would like to know if there is a better way to do it, Thanks. | 2011-07-12 09:14:00 Author: Lordwarblade Posts: 761 |
No, unless you start charging money to play your levels (imagine that) you should be fine copyright wise. And, for the quality of recording, my best suggestion is to make sure all ambient sounds are at a minimum; This includes televisions in the background, doors or windows open, and your mom talking with your grandma on the phone about flowers. (Go outside, Mom!) Also, one method that works for a lot of people is putting a cloth over your microphone to stop spit and air from hitting the mic, creating noise. That's what you see in the funky hip-hop videos, with rappers yelling into microphones about obscenities and such. In front of that microphone is a disc-like piece of fabric called a 'pop filter', and it does exactly what I explained. However, this is usually only used for recording real-time voices, but you should try it nonetheless. Hope I helped! | 2011-07-12 09:48:00 Author: nunsmasher Posts: 247 |
Thanks a lot for the help nunsmasher it's funny because every time i tried to record today my mother actually did come in a try to talk to me many times. Eventually i banned her from my room for the day No, unless you start charging money to play your levels (imagine that) you should be fine copyright wise Sorry if i sound like an idiot but i just want to clarify what exactly you meant. No it bad or no its fine to use the recorded game voices. I like the idea with the cloth i will have to test it out so thank for that. I was originally going to ask someone to do voice recording of duke nukem but thought it would be great to use the real thig to give it more of an atmosphere. | 2011-07-12 10:29:00 Author: Lordwarblade Posts: 761 |
No, you don't have to worry about copyrights, because you aren't making money for playing it. | 2011-07-12 10:32:00 Author: sp0ngyraver Posts: 407 |
ok thanks a lot spOngyraver and nunsmaher. I didn't think it would be a problem but just wanted to make sure. | 2011-07-12 10:41:00 Author: Lordwarblade Posts: 761 |
The "not making money " copyright argument is passed around a lot these days. Just to inform you, you are completely wrong about that statement. People who do this get away with it because they remain small enough not to get noticed. Being succesful (by making money with it) puts the spotlight on you. In many countries, a company needs to protect its IP from even the smallest infringements in order to be able to support a case against potentially larger violations. Chance you get caught with your custom level in LBP2? Very small. But don't assume you are in your right to baldly use another company's IP just because you don't get paid. Consider giving your level a good twist; make it a sackboy parody of Duke Nukem. This may put you in the fair use category, will render you more original and it may actually benefit the quality of your level. Why not imitate Duke Nukem with your own voice? You'll sleep better at night knowing that your creative work is sound and safe. | 2011-07-12 12:04:00 Author: Antikris Posts: 1340 |
Thats a good point but destroys the level i am making i have made a holo duke and was building a level like the Duke Nukem games. I didn' want to use sackpeople at all. I also have a british accent so i can't really impersonate his voice as it comes out all wrong. I have known people to add voices from games in mods in other games such as Fallout and Oblivion and Unreal so not entirley sure if i can use them in my level. A Duke Nukem level with no Duke Speech just wouldn't work. I was thinking though of making it with sack people and calling it sack Nukem but i don't really like that idea much and it wouldbe harder to make. | 2011-07-12 12:27:00 Author: Lordwarblade Posts: 761 |
I also have a british accent so i can't really impersonate his voice as it comes out all wrong. I think a british version of Duke Nukem would be hilarious. The point of a parody is that it doesn't have to be Duke Nukem, just a character based on him. "I'm here to drink tea and kick ***. And I'm all out of Earl Grey." A Duke Nukem level with no Duke Speech just wouldn't work. I was thinking though of making it with sack people and calling it sack Nukem... Jack Sackem. ...but i don't really like that idea much and it wouldbe harder to make. An LBP2 level not using sack people harder to make than without sack people? I look at your warhammer sig and I rightfully disagree. | 2011-07-12 12:45:00 Author: Antikris Posts: 1340 |
I did toy with the idea of a parody of Duke Nukem but wasn't overly keen really as i am a big fan of the games and wanted to make this as close to the real thing as possible. Most of my levels i have made have no sack people as characters except for display like my top down games. The sackpeople in my 40k sig are just display and can't be controled, in the 40k level you control topdown models of the terminators and i have made a side view model with a sack person in it but again you control the model not the sackperson. I found that creating a sack person with usable weapons and what not to b harder than holo or flat models. I did originally think of Sack Nukem or whatever i was going to call him before i had made a holo duke. Originally holo duke was going to end up in an arcade mini game that sack duke could play. I suppose i could go back to that unforunatley i will lose most of my game play logic i have made doing that and also enemies would be a lot harder to make like the pig cops thats why i chose the holo idea. Still though i could think about the old idea. I don't really want to use my voice in the level though and to b honest i prefer to play levels that have custom models and no sack people though thats just me. I will have a good long think about all of this before i carry on though as what i am making is very hard and i would hate to have it taken away once published becuse of copyright. Maybe i can find somebody who can do the voice overs for me? Edit: Also sackpeople tend to use a lot more thermo than models made from certain materials i have found as my original concept for Sack Nukem uses almos a whole bar more than my holo Nukem and has hardly any logic attached to it yet. **** these dilemas. | 2011-07-12 13:01:00 Author: Lordwarblade Posts: 761 |
Here's a tip... A PROtip as it were... This is LBP. Don't worry about copyright as long as you arent defaming the franchise. Companies (mainly nintendo) have learned their lesson about trying to stop creators form creating levels around their games... It is good press for the company you are borrowing from. So don't worry too much about this. I say just dont say anything bad or inflammatory about Duke or his series... No matter how *AHEM* bad his latest venture may have been... | 2011-07-12 13:14:00 Author: poorjack Posts: 1806 |
I already have recordings of his voice from games so i just relly now need to decide wether or not to use them. Has anybody actually played a level on LBP that has used recordings from another game or movie or something? @Poorjack - Dont worry I wont be defaming the franchise if i make it a proper Duke Nukem level thats why i have made him out of holo to looklike the charracter. Though a parody of Duke i don't think i would be able to use the voices from the games. (Not sure about any of this) I actually didn't mind the latest game that much to be honest. Well here are the pics of me Duke's what do you think would make a fun experience. Though the sack version does look good the gameplay logic will be harder for me to make as well as the enemies. Also more thermo will be used in the level. Holo Duke dosen't look crack hot yet but the level will be better on thermo though the animations will be awkward though the real voice will work nicely. Well here are the pics of me Duke's what do you think would make a fun experience. Both look great! It is all up to you. | 2011-07-12 13:33:00 Author: Antikris Posts: 1340 |
I'd say it all depends on wether or not i can use the voices then because if i can't then it will be Sack Nukem i suppose. Though there are so many Duke Nukem levels out there using Sack People. Should this be moved into the ideas thread area? | 2011-07-12 13:41:00 Author: Lordwarblade Posts: 761 |
Lol Lordwarblade that game sounds like it will be awesome and hilarious! Im working on a Zelda game with Links real voice recorded too and wondered if the level would get taken down due to copyrights :/ Not sure how much you could say with Duke Nukem seeing as how most of the language in the game is vulgar XD "Eat **** and die!" | 2011-07-12 19:32:00 Author: Dortr Posts: 548 |
I guess I forgot to mention the copyrights depend on what country you are in, different countries have different laws concerning Intellectual Property. Basically nobody can rly build a case for you using short recordings in an LBP level, I think as long as a certain % of ur lev el is custom, you can use cuts of other ppls work and it is not considered infringement. I would have to consult the book for the specifics on thy one. But for an LBP level initially wouldn't worry about it. | 2011-07-12 19:54:00 Author: sp0ngyraver Posts: 407 |
@sp0ngyraver Ok thats sort of what i thought aswell. I think i may just make it then if its taken away by MM i'll just redo it without the voicovers. @Dortr - Going by yourr VvV levels i think a zelda would be breat with the real voices. Yeah the problem with Due Nukem is i have to be carefull what i put into it. nfortunatly most of his sayings are vulgar so i have to avoid them ones (Unfortunatley their the best ones) There should be an option to make our levels for the mature players like if the option is selected it says Warning Mature content and only players who are 15 bor older or what ever the age is would be able to play. That way at least we could swear occasionally. | 2011-07-13 01:54:00 Author: Lordwarblade Posts: 761 |
Wow I just realized how many words I misspelled in my last post. And to think I was the Spelling Bee champion in 3rd grade, good to see it wasn't squandered. I'm sure typing on this iPhone keyboard makes it so much easier too. Half the words I type on this thing get autocorrects into other words. See?! it just autocorrected "autocorrected" to "autocorrects". | 2011-07-13 02:17:00 Author: sp0ngyraver Posts: 407 |
Yeah my spelling on this site seems to be attrocious as well and im using a keyboard. | 2011-07-13 03:14:00 Author: Lordwarblade Posts: 761 |
