Do you think songs in LBP2 should be copyrighted?

Archive: 10 posts

I personally do not because if they were, I would have to ask every single person I got music from if I could use their song in a level. I seriously do not think this is necessary. Your thoughts?

Edit: I am referring to music sequences.

Depends. If the music is given away it is clearly done under the knowledge it can and will be used in levels. So I don't understand what point in copyrighting would be. It's the same as levels. Make them copyable and people WILL publish them as their own. Don't and they can't do it unless they remake the level themselves. Same applies to music. Or any other prize given away to people. If you don't want people to use them, don't give it to them.2011-05-24 16:23:00

Wouldn't MM own any copyright of anything produced within LBP2? It is software with instruments designed and produced by them.

But agree with Moonface
If you don't want people to use them, don't give it to them.

I think so too, besides that, what would the point of a copyright be?
(it's not because there is a copyright people aren't gonna steal it)

Uh, copyright actually exists at the moment of creation. Everything created in LBP1/2 is automatically copyrighted. I never bothered reading the EULA (who does?) but I'm quite sure that Mm retains rights to anything created using LBP.2011-05-24 21:08:00

To clarify this point - anything you create in pretty much any medium is automatically covered by copyright, and you are the copyright owner, but the LBP EULA states that when you publish something, you implicitly grant a non-exclusive license for anyone else to use that stuff without your permission.

So you don't have to ask others for permission, but it's probably polite to do so.

Unless the music is offered as a free prize bubble, there ought to be some sort of acknowledgement if it's used (at least a statement saying "song by _______"). That's the polite thing to do.

But like Aya said, once your music hits public domain, it's free range.

^^ This.

MM isn't involved in this process at all. The Sony Online ToS covers User Generated Content in quite a lot of detail.

USER GENERATED CONTENT. This game may include tools that give you the ability to communicate with other players and to post pictures, photographs, videos, game-related materials and other information, either on particular versions of the game you play or in community areas (individually and collectively, "User Generated Content"). When using these tools, you are solely responsible for your own User Generated Content. By posting or submitting User Generated Content in any manner, you grant SCEA, our affiliates, licensors, and distributors a worldwide, perpetual, non-exclusive, sublicenseable and transferable license to use, copy, display, perform, distribute, adapt, modify and promote the User Generated Content in any medium. You represent and warrant that you own or have all necessary rights and licenses to use and authorize SCEA to use all patent, trademark, trade secret, copyright or other proprietary rights in any and all User Generated Content to enable inclusion and use of the User Generated Content in the manner contemplated by this Agreement.

To comply with the terms of this Agreement, you will not submit any User Generated Content that (a) is protected by copyright, patent, trademark, trade secret or otherwise subject to third party proprietary rights, including rights of privacy and publicity (unless you are or have permission from the rightful owner); (b) is fraudulent or a misrepresentation that could damage SCEA or any third party; (c) is unlawful, obscene, defamatory, threatening, harassing, predatory, pornographic, hateful, racially or ethnically offensive, or encourages conduct that would violate any law, or is otherwise inappropriate; (d) is an advertisement or solicitation of business, (e) is an impersonation of another person; or (f) violates any of the rules of Online Conduct, other terms of this Agreement or any other terms related to this game.

You agree that SCEA is not responsible or liable for User Generated Content submitted or posted by you or by others. SCEA does not claim ownership of any User Generated Content that you submit or make available as part of the game, and SCEA expressly disclaims any and all liability in connection with any User Generated Content. User Generated Content will belong to you or your licensors. SCEA has no duty to pre-screen User Generated Content. SCEA has the right to edit, remove, or refuse to post any submitted User Generated Content for any reason without prior notice, but is not responsible for any failure or delay in doing so.

It goes without saying, but be careful who you let into your moon and be up front if you are providing music for someone else's level. Let them know your terms (i.e. no prize bubble, music credit mentioned in level description, whatever) ahead of time.

This is a very good thing to do. If I ever use someone else's music I will give credit.
