Playstation 3 Blocked in Europe - By LG

Archive: 50 posts

Recently LG won an injunction against Sony that has resulted in all Sony Playstation 3 consoles blocked from reaching Europe. Will this ban spread to the USA or Canada?

What the hell!? I may live in the US, but even I think that's unfair.

Why couldn't they just block out Britain???

Atleast it's only 10 days for now.

Wonder if Sony will manage to do the same back to LG as part of this patent war.

They did. Sony took them to court on December (and won I think). That's why LG's doing this, only they're going all out on Sony this time.

Again, it's not just greed, it's this patent war they're having with Sony. LG just can't take a loss; they're willing to put another company out of business just to get the upper hand in life (I doubt Sony will lose business, though).

Yes, why wouldn't they? It's the technology in the console not the games that has the patent problems.

For anyone afraid that this might happen in the U.S:

It can't.
It wouldn't be allowed, because big corporations are protected from patent stuff like this.

Ex: CocaCola patent was up, the courts extended it so they wouldn't lose their seat by a bunch of nockoffs.
If they tried this in the U.S I wouldn't be surprised if the courts laughed at LG.
The U.S doesn't like to see bid corps taken down quickly.

If Microsoft (http://www.computerworld.com/s/article/9142611/Court_rejects_Microsoft_appeal_bans_Word_sales) are not too big to be given this "protection", who exactly is?

Also, pay attention to the mobile telecomms market - those companies are never out of court with their patent squabbles.

rtm, the only reason they did anything about Microsoft was because they had gotten TOO big, which made it impossible for any other company to get into the market.

Thats not the case with Sony.

From wiki

The Blu-ray Disc Founders (BDF) group was a collection of technology firms working together to develop and support the Blu-ray Disc. The Blu-ray Disc Founders was launched on May 20, 2002. As Blu-ray support grew progressively; announcements in 2004 included Hewlett Packard and Dell, which declared backing for the standard on January 12, 2004, and TDK on March 19, 2004. It announced that Blu-ray Disc Founders will shift to Blu-ray Disc Association (BDA) in October on May 18, 2004. It shifted to Blu-ray Disc Association on October 4, 2004.

The companies are:

Sony Corporation
20th Century Fox
Dell
Hewlett Packard
Hitachi
LG Electronics
Panasonic Corporation
Mitsubishi Electric
Philips
Pioneer
Samsung Electronics
Sharp
TDK
Thomson
So I wonder the reason why Sony and LG sue each other since their associates in the development of the technology.
My take is a great loud:
BAH!

The case I linked to was specifically I patent infringement, by microsoft, causing an injunction technology product to be withdrawn from the market in the US - that thing that apparently isn't possible. Nothing to do with MS's supposed monopoly status and the big hoohar that was made about that several years ago.

And these injunction requests on (often dubious) technology patents are made regularly in the US courts. It's rare that they go as far as a full block on sale of a product (which is the same as elsewhere in the world), but it's a million times rarer that they get "laughed out of court". Normally, it's a standoff of counter suing or a multi-million dollar settlement that solves it, not the courts ignoring them or protecting big companies.

Basically, similar things could happen in the US. It's unlikely, but it's unlikely for them to happen in Europe too... yet here we are

Firstly this ban does not affect consoles already in stores, it is unlikely that anyone will struggle to purchase a PS3 even without imports it wont effect stores too much.
Yes some stores will go out of stock but they will get them back in once the import ban is lifted.
No software will be taken off sale as they are owned by the maker of the software and LG can't sue anyone that has ever released a product for the PS3.

To be honest I think LG is being childish but who am I to judge when millions of dollars are being thrown about by two large corporations.

It is likely that SONY will appeal the block and have it lifted before the 10 day period is up.

If anyone prefers some reading material instead of the guy playing parrot in the video, try this: http://www.guardian.co.uk/technology/2011/feb/28/playstation-3-lg-legal-dispute

Anyway, I hope the ban gets lifted soon. I find the entire situation a little petty myself, since if LG really cared about this patent thing why leave it until years after the PS3 was first released.

I was kidding about the LG boycot, but I saw that some people is quite "serious" about it...so serious that they opened a FACEBOOK LG Boycott page!!!
Actually in an eventual boycot scenario I think that LG is the only brand that will lose.

Let's see, rising Korean electronics giant versus long-time Japanese electronics titan. Not hard to do the math on this one. I remember when living in Japan going to all these big electronics stores and noticing the LG/Samsung brands were generally cheaper then the big Japanese names (and obviously not as popular). Personally I have always equated the Sony brand with quality and their products have been a permanent fixture in our home ever since I was a kid. At the end of the day it's all business and although LG might have won this small battle they will never win the war.2011-03-01 12:08:00

Sadly, this kind of behaviour is all too common.
Corporation fighting in this way actually impedes the advancement of the human race - advancements in technology are slowed down because corporations want to extort more money from each other and the customer... and in the end it's us, the consumer, that loses out.

They both look like childish morons doing this kind of thing, it will only harm both of their companys image.

As I said it's strange that a member of an association sues another member.
Bah, I've got like the idea that the LG wants to milk the Sony cow with some trick, and I smell some big political Japan-Korea affair mixed.

I bought a Samsung cell phone and a Samsung TV...good but not top class, and my experience with LG stuff is that their stuff is absolutely not user friendly.
And yeah...Sony means reliability for me, so I'll stick with their party.

They said they had stock for about 3 weeks.

RIGHT?!

All they havem IF SONY looses, it will loose a massive amount of money, may "potentially" bring it down.

For anyone afraid that this might happen in the U.S:

The U.S doesn't like to see bid corps taken down quickly.

If SONY looses over there, it looses everywhere (because it'd still have to pay LG the massive amount of money.), so it doesn't matter if its legally protected anywhere or not.

Exactly, it's unlikely LG wins the case but if they do, it'll be a HUGE detriment to Sony, and it may be the end of the Playstation 3. Are they even making profit from PS3 sales yet? I remember about a year or two ago when I heard they were actually losing money for every PS3 sold. Does this still hold true? Not entirely sure but the fact that LG has gotten this far is a problem and it is possible we can see it in the United States. As the video states, the courts here and in Europe are not that different, if they can win an injunction it's possible we see it here.

Though this is all just my 2 cents.

Funny stuff...I'm no comunist LOL, but I would love a fair World where if LG wants a piece of the Playstation pie (because that's what LG want), they must take both the piece with mould and the one with the jam.
LG, you want Sony to share with you the outcomes of Playstation? Then be ready to pay a percentage on Sony's losses too...

The PS3 hardware is currently selling at cost with profit coming from the offers on the bundle packs. Sony were never taking such a huge loss on the hardware with one or two purchases of software quickly making up for the loss taken on the console.

Meh, my LG TV was big and it was cheap - and so far (2 years on) I have had no complaints with it.

This is just another example of copyright lawyers sticking their greedy beaks into business and ruining things for the consumer *golf clap*

According to PlaystationLifestyle (http://playstationlifestyle.net/2011/03/10/300000-ps3s-were-seized-valued-at-e43-million/) , 300k consoles have been seized for a value of 43 millions of €.

Update!
YAAAAAAAAAY!!! (http://www.gamersmint.com/sony-wins-all-seized-ps3-to-be-returned-and-lg-fined/)

Sony’s won their case against LG and will be getting all their seized PS3’s back.
All 300,000 PS3s will be returned back to Sony and all future PS3 shipments can be let into Europe without any issues or breach of law.
LG will also have to pay 130,000 euros to Sony for the costs of the hearing.
LG will also need to ensure that all seized PS3s are returned to Sony by tomorrow and each day they lose will cost them a fine of 200,000 euros.
This verdict is only regarding the seizure of the console by LG and the fight between the two giants regarding a paten breach will continue.
