[Legal question] MM's Music, can I use it?

I'm making an 'animation short' soon for my studies, and it has nothing to do with Little Big Planet, I'd just really like to mix together the interactive track of 'Victoria's Lab', and use that as the music for my animation.
I was going to contact MM directly, but got a bit confused by the whole process of contact thing, as I wasn't sure what category to put my question under.

My question is, am I able to use the music for my animation? (With MM/(Or at least a representative)'s approval, of course. As well as credit for the music (Which MM would then have the right to say what kind of credit they would want in the short))

The end product of the music I'm aiming for is pretty much like the one in this video, just with less of the opera track:

EDIT: The animation itself is inspired by "The Sorcerers Apprentice" (The one with Mickey Mouse in it), Tarboy, a few little things I've seen around, as well as the scene in "Horton Hears A Who", where Jojo is revealing the giant musical machine he has built.

If you want to do everything correctly you will need to contact Mm. I had a legal query I wanted to make with Mm. I just sent a simple message via the "hello" option on their contact page explaining the basics of my question,so it could be passed on to the right person and then they could start more detailed communication. I got a response a few days later.

You could risk using it without permission. It all depends on what you animation includes and what it is used for that will determine what (if any) legal action is taken. If your animation was used for commercial purposes or promotion then you would expect a letter from a lawyer. If your animation is something you're producing for fun, it is not offensive, and is only posted on YouTube then it's unlikely any action will be taken.

I am not recommending that you use copyrighted material in your animation without permission as it could lead to legal action. I recommend contacting Mm (as I did), or try to find a copyright-free source of music that is similar to the Mm music.

It depends.

The Interactive music in the game has been produced by people FOR LBP2, and the Victoria's Laboratory Intro. Music is interactive, therefore needing permission.

However, the other ones which don't have sliders to cue parts (take Sleepyhead by Passion Pit for example) probably won't require permission seen as Mm used them and they are existing albums. So if you have something like Spotify and type in the track you want it'll probably find it.

And all the LBP1 music was available on iTunes too.

@mutant_red_peas: All of the music is copyrighted with the copyright belonging to a variety of owners. Sony will have paid licensing to use the material in game, which transfers no additional rights to purchasers of the game. Buying it on iTunes etc. will also not automatically transfer any rights to use it in your own new materials


However, if it's for your studies it should be covered by fair usage anyways, in most parts of the world. You may as well ask though, it won't hurt
