Copyright issues

How are Mm going to stop people from using any song they want? Is it just simply removing the level?
And what kinds of stuff do they allow you to use in a game? Because I heard lots of levels got removed in LBP, but I never found out what for.

It's good to know what you can put in a game I'm talking specifically music. Youtube for example, you can use what you want.

I didn't heard anybody get any harm from transcripting something to midi and distribute it, so it should be the same with LBP22010-11-04 22:16:00

As long as it's not the original song (with vocals and all), it doesn't matter if you put in "instrument form" in LBP2.2010-11-04 22:36:00

I agree that it's mostly a non-issue, but if an artist or record studio decides to sue, expect a blanket ban on all copyrighted songs even if the lawsuit ends up being baseless.2010-11-04 22:42:00

You will sometimes hear radio stations put together their own versions of specific songs, performed with a different backing track/vocals. In the UK at least they are allowed to do this (I think - there may be strings attached) without having to fear copyright infringement - so you should be allowed to reproduce it in a non-profit way, such as in LBP2, without a problem.2010-11-04 22:49:00

Hahahahaha...no. Youtube definitely does NOT let you use what you want. It's extremely easy to get your movie muted or removed by Youtube for copyrighted content.

At least in the US, there is a difference between distributing a copyrighted recording (like an MP3 file) and an original recording of a copyrighted song (like a MIDI file, LBP2 music object or even a recording of you playing it yourself on the piano). Simply put, you're not supposed to use something you don't own.
Now, in execution it a tad more complex. You have the right to reproduce a song in the music editor because it's your creation even if you're reproducing something that exist. If we could record music and put it in the game, now you'd be against the law to put the real song in the game.

In matter of images and names, it's the same thing basically. You use what you own and the rest you need permission. If the name is trademarked, you're not supposed to name something or yours with that name.

Lastly, there's also the notion of "fair use" with is certain "fan things" the law ignores/tolerates. But this is grey zone. It's not perfectly defined and it's dangerous to play with that. A fan work (level) in LBP about real games shouldn't be a problem in itself.

Mm changed the way they deal with copyright infringement pretty quickly after the release of lbp1, people got sick of their levels behind deleted harshly and without warning.

What they did, although they didn't say it precisely in these words, is that now they only look at levels for infringement if a company files a cease and desist order.

Which never happens.

So we're basically fine.

Seriously though, is Nintendo really going to complain if someone makes a Mario themed level (music and all) on LBP? On one of sony's flagship titles? It's like free advertising!

But increases the value of host product by using content that they not own in same time. It's maybe bad for community but on other hand people (and this includes corporations) need there rights to maintain control over there brends and trademarks that contains value that they earned. It's highly debatable issue and probably never gonna be solved, all brand on brand owner likes.

Btw Nintendo is known for keeping there stuff only on there platforms
