User Generated Content Question

I'm going to make some levels that has some characters that I'm going to later use for my own video games (these characters have nothing to do with Little Big Planet in there own games).

I am worried that by putting them in Little Big Planet that i might be giving the rights to sony or mm.

What makes me think this is the User Generated Content Part of EULA.

These characters are very important to me I spent a lot of time designing them.

Any Information about this would be appreciated

I struggle with the same problem! The answer: I don't know.

However, in the EULA, they may just mean the right to take the level itself, and use it in promotional content and use just the level for themselves.

Like the time Mm recorded Kiminski's Sonic level for Sonic DLC that was released. They gave credit too.

The copyright will still be owned by you, but by publishing your characters, you can't sue anyone else who uses them. It also states that Sony can sue you if you attempt to make any money from your content, although to what extent any of this is enforcable in a court of law is somewhat questionable (http://en.wikipedia.org/wiki/Software_license_agreement#Enforceability_of_EULAs _in_the_United_States).

If you are designing characters to put in a video game you intend to sell, the best practice is to not publish your art resources in any publicly available form. I would suggest making two different sets of characters: the ones for your levels and the ones you intend to use in your game.

This being said, the EULA is mostly there so that you can't claim royalties or copyright infringement if Sony decide to use parts of your level in promotional content. If you are worried about Sony sending you a legal threat because you've used characters that you published in LBP, I think it's highly improbable that they would go through all that trouble.*
