Copyright Violations and Tribute Levels

I've seen quite a few tribute levels and hope to try and make one someday but copywrite violations worry me. I just really wanted to ask what sort of things would be safe to add to a tribute level and what would be dangerous enough to get me banned. Thank you, it would really help ^^?2010-04-04 18:25:00

Um... that's copyright.

I don't think you can get banned, at least I've never heard of such. The only thing I know for sure is that if someone Good Griefs your level for copyright and the level contains copyrighted material (I assume copyrighted images, and maybe names as well), then your level might get pulled from the servers. That's it.

IMHO, it's not really worth worrying about it. However, as a rule of thumb, using actual copyrighted images probably increases your risk, so you should avoid using those if you can.

I think things games that are made by sony or are sony exclusives are usually fine. The are other companies that have given the ok to the moderaters also but theres no definitive list or anything.2010-04-04 19:17:00

Oh? Thanks for correcting that *edits* :blush:! Lol, I have this fear of not citing my references correctly and getting accused of plagiarism when it comes to writing school papers (hence copywrite XD), I guess it carries over ^^.

Well, I'm thinking more along the lines of images taken directly with the PSEye.

For the rest, I can only assume that modifying the imagery and names to a minor extent can help, but then again many levels blatantly use names, locales and characters from copyrighted works without being moderated. Whether they would be pulled if someone reported them is anyone's guess. There's really a lot we don't know about the moderation system.

What I do know is that being a popular creator or having a popular level seems to greatly increase the odds that some people will Good Grief a level for no other reason than for the lulz.

I think that, legally, this is a bit complicated (as though anything were ever legally simple these days *cynical sigh*). I'm sure there would be a question of who would be responsible in cases of supposed copyright violations: the creator or Cambridge (or Sony). Even though all user-generated content is free to download, and nobody profits directly from the publication and sharing of levels online, Cambridge could be said to be profiting indirectly from the free shared content as it is essentially part of the game experience, and helps to sell the product, and Cambridge/Sony are responsible for the actual publishing and distribution of the content. This at least means that I'm sure you won't get prosecuted by anyone.

As for Cambridge and Sony moderating content, they certainly don't seem to proactively moderate potentially copyright content to protect themselves. My level "Star Wars: TIE in the Sky" has been online for several weeks now and has so far remained intact. I didn't change any names and intentionally sought to faithfully recreate the look of several recognisable Star Wars ships etc. I've had somehwre near 3,000 downloads now and I haven't been banned for ANY reason yet, but maybe I'm just lucky. A creator Julesyjules has made a series of Star Wars levels on PS3 that have received quite a lot of attention and as far as I can see these haven't been banned either. Taffey's Star Bores levels are, I suppose rather wisely, parody levels that change the names of characters and locations, but he has still very accurately recreated some vehicles and locations and has remained unscathed, and 'A New Hop' has been on the highest rated page for weeks, so somebody MUST have noticed it.

But that's just Star Wars. I really don't know how to conclude or extrapolate from that, but there are a few facts to think about anyway. Has anybody noticed any warning about using copyright material at all in any official context, like in a tutorial or the instruction book? Sackboy is a registered trademark and I use him in almost all of my levels

It doesn't seem to be a huge problem from what I can tell - there are literally hundreds of Star Wars levels online, some of which have images directly captured from the movies. The 'Official' Level of the Year was based on the game 'Dead Space', and there are plenty of high profile levels based on Nintendo IP's that have remained published. SteveBigGuns's Mario level was the highest rated level out there for a long time and recently got moderated, but i think that was a common problem with being on the Highest Rated page, and wasn't due to the content.

If it still worries you, then maybe publish the level exactly how you see fit, but keep a safety version so if your level does get moderated you can easily re-work it and republish.....

Instead of giving a technical response, I will just tell you that this is one of those hint hint wink things where they don't like it, but won't usually ban it. I was carving out an epic Escape The Fate logo for a tribute, but it got lost when I lost my save. Good luck.2010-04-14 13:06:00
