Wtf?!?!?!?!??!?!?!?!?

Archive: 19 posts

Hey, MM.

What's THIS?!?!?

PANDAmonium (By Cstrfrk): I?m an animal lover, so I really got into this level. It's a fun romp through nature hopping along the beaks of cranes to cross a river and delving into a dark cave lit up by fireflies, all to reach the panda celebration at the end. The animals, especially the pandas of course, are really cute and cartoony, and the backgrounds are beautifully constructed.

That was taken from VGBlogger's overview of the levels in the GOTY edition of LBP. All I have to say is: WTF?!?!?

I made a level called PANDAmonium. Only I published it back in 2008. It was all about pandas too. I demand this level be removed from LBP before I take legal action.

It's not like Pandamonium is a very creative name for a level with Pandas. 2009-09-14 22:11:00

I'm betting that in the user agreement you have to accept to play online it has some fine print about "ownership" of levels. I'm not a lawyer but I don't think you've got much recourse in this.

btw, I remember that level you made... cute pandas

Yeah,Morgana is right. You don't own the levels you publish.2009-09-14 22:16:00

Unfortunately, there are many levels out there that share the same name... it's bound to happen often with so many levels being published. I think if the level looked like yours and was a blatant rip-off, you'd have a reason to really be PO'ed.2009-09-14 22:20:00

So was the level a complete copy, or was it just the name and pandas?

Copyright does not cover ideas and information themselves, only the form or manner in which they are expressed. For example, the copyright to a Mickey Mouse cartoon restricts others from making copies of the cartoon or creating derivative works based on Disney's particular anthropomorphic mouse, but it does not prohibit the creation of other works about anthropomorphic mice in general, so long as they're not copies or adaptations of Disney's mouse.

From the 34 U.S. (8 Pet.) 591 (1834).

Don't worry, you don't have any intellectual property on the stuff you create in the game. It's not commercial stuff and Media Molecule can alter, modify. remove it as they see fit.

EULA should tell you about this in detail or if your read PSN terms on Sony's site.

And anyways, it's probably just a coincidence. I could have thought of that title myself.

Actually your user generate content still "belongs" to you. But they also state that they can use, sell etc your stuff however they please. I'm not sure they understand the word "belong" TBH

TBH I think the sarcasm is implied when it's awesomemans posting

I think Awesomemans should have to pay Pandas for using their name. CLEARLY this is a copyright infringement.

And there was a commercial game called Pandemonium published by Crystal Dynamics, so I think he also needs to pay Crystal Dynamics for copyright infringement - simply replacing the "e" with an "a" is still enough to cause gamer confusion (which is certainly akin to having an upper case "PANDA" verses a mixed cased "Panda".

Awesomemans is going to be broke when the legal dust settles...
